J&S Transportation Terms and Conditions

Definitions
J&S, we, us, or our means J&S Transportation.
Customer or you means the individual or company placing an auto transport order.
Carrier means an individual or company with their own truck or fleet of trucks.
Broker means an individual or company that subcontracts with carriers to complete transports.
Subcontractor or “another carrier” means a carrier not owned by J&S that is hired to complete a transport when J&S acts as a broker.

J&S is both a carrier and a licensed transport broker. If J&S does not have one of their own trucks on the Customer’s transport route, or if another carrier can complete the transport quicker, J&S will act as a broker and subcontract the transport to another carrier. J&S will remain the main point of contact throughout the transport whether it is completed by J&S acting as a carrier or broker.

When a Customer places an auto transport order with J&S online or by phone, the Customer agrees that their transport will be completed by J&S acting as a carrier or broker, and agrees to the following Terms and Conditions.

Customer’s Responsibilities
1. The Customer authorizing the transport is the legal owner and /or has permission to transport the vehicle. J&S will not be held liable for any transportation of stolen vehicles.

2. Any misrepresentation of the vehicle could be subject to additional charges payable by the Customer.

3. Customer agrees and acknowledges that the vehicle will be ready for transport according to the criteria outlined here.

4. We allow ONE suitcase, duffle bag, tote, or box of personal belongings up to 100 lbs. J&S and its Subcontractor are not responsible for any personal items. You also agree to all the terms outlined in our personal belongings policy.

5. Customer agrees to work with J&S exclusively on their transport. Having multiple transport companies working on the same transport is a huge problem and only hinders the process. J&S refuses to participate when multiple transport companies are involved. If at any time it is found that another transport company (carrier or broker) is working on the same move for the customer, J&S will cease efforts to ship Customer’s vehicle and no refund will be given to the customer.

6. It is understood and acknowledged that if the driver is unable to meet the Customer at their desired pickup or delivery location, then another safe and secure location must be available for the driver to meet the Customer.

7. Customer understands and acknowledges that if a damage claim is filed, the insurance coverage will come from J&S if the transport is completed by a J&S truck. Otherwise, insurance coverage will come from the carrier that J&S subcontracts to in a broker relationship.

J&S’ Responsibilities
1. Transportation quotes from J&S, either on the website or by phone, will include pick up and delivery forecasts. These forecasts are ESTIMATES based on the earliest date the vehicle is available for pick up and other factors. J&S agrees to make every reasonable effort to meet those estimated pick up and delivery dates. However, given the nature of trucking, J&S cannot guarantee specific times and dates of pick up and delivery. Unexpected delays can sometimes occur due to weather, traffic, road construction, and truck breakdowns.

2. If there are any unexpected delays for pick up or delivery, J&S or its Subcontractor will make every effort to notify the Customer immediately. J&S or its Subcontractor are not liable for any claim or loss of services in the event of a late pick up or delivery.

3. It is understood that J&S and its Subcontractor will not be liable for or reimburse any auto rentals, storage fees, or any other additional expenses incurred before, during, or after the transportation.

Fees and Payment
The quote and order process works like this:

1. The customer generates an instant quote on our website or by phone from a J&S representative. If the Customer proceeds to book an order online or by phone with a J&S representative, a 10% deposit will be charged to the Customer payable with a credit or debit card. PayPal is also acceptable for online orders only.

2. The credit or debit card information used to pay the initial 10% deposit is fully encrypted and stored in the J&S payment system. The remaining balance due on the order is automatically charged to the customer’s card on file upon the pick up of the vehicle.

3. If the card on file is declined at the time of pick up, a reprocessing fee of $20 will be charged to the Customer. The customer will be contacted and informed of the additional fee and will be required to provide another credit card or debit card if necessary to complete the payment of the transport.

4. By entering the credit card information online or by giving it to a J&S representative by phone, it is deemed that the customer is the legal card holder or has permission from the card holder to use the card, and authorizes both the deposit and remaining balance due to be charged to the card.

5. If PayPal is used as the payment method for an online order, the initial 10% deposit will be paid by the Customer through their PayPal account. J&S will send a PayPal invoice to the Customer for the remaining balance due and it will be required to be paid by the Customer on or before the day the transport is assigned to a driver. A J&S dispatcher will notify the Customer when the transport has been assigned to a driver.

Cancellation and Refund Policy
If you place your order online, a customer service representative will call you within one business day to verify the details of your order and will let you know if there are any adjustments necessary to your transport rate. You may cancel your order and get a FULL refund of your 10% deposit, up to the point of, and during, that verification call. If you agree to move forward with the transport order after that call, your 10% deposit becomes NON-REFUNDABLE. If you call to place an order, a customer service representative will confirm the transport rate during that call. If you agree to the rate and agree to move forward with an order during that call, then the 10% deposit is NON-REFUNDABLE.

Damage Claims
1. In no event shall J&S or its Subcontractor be liable for any damage to vehicles except for damages to vehicles actually transported and only to the extent that such damages were caused by negligence or misconduct. The Bill of Lading/Vehicle Condition Report must be signed at the time of pick up and delivery and any damage must be notated on the Bill of Lading/Vehicle Condition Report. Signing the Bill of Lading/Vehicle Condition Report at the time of delivery without any notation of damage will be evidence of satisfactory, damage-free delivery of the vehicle.

2. If damage does occur during the transportation, the Customer must file a damage claim as per J&S damage claim policy.

3. J&S and its Subcontractor are not responsible nor will have any liability for claims of the following nature:

  • Damage caused by leaking fluids, battery acids, cooling system antifreeze solutions, industrial fall-out or fall-out resulting from Acts of Nature and/or Acts of God. To include, but not be limited to: sandstorms, hailstorms, tornadoes and hurricanes.
  • Damage or loss of loose parts or special equipment when not listed on the Bill of Lading and/or when not properly wrapped, stored or secured.
  • Mechanical malfunctions exhaust system, alignment, drivetrain (including differentials, transfer cases, transmission, and engine) or suspension because inspections of these items are not practical at time of shipment.
  • Damage caused by freezing of cooling systems, fuel systems, or batteries. Protection from freezing will be furnished by and at the expense of the shipper.
  • Damages to the exteriors of a vehicle where the paint is not broken, paint scrapes 1″ long or less or an isolated “chip” in the paint is not covered. This also includes paint swirls, flat tires or missing hubcaps.
  • J&S and its Subcontractor are not responsible for any non-factory accessories such as after-market stereos, equipment, phones, radar detectors, and any other personal items.
